Tarrant County Felony Alcohol Intervention Program or F.A.I.P. addresses several of the concerns of criminal defense attorneys for repeat offenders.
Tarrant County created F.A.I.P. to increase public safety, decrease the costs of incarceration, and treat individuals. This is especially true because repeat DWI offenses often indicate a substance abuse issue.
Once a case is filed, the director of the program searches for cases that meet the criteria. The District Attorney’s Office must also approve. The court notifies the defense attorney and his/her client has the choice to enter the program.
F.A.I.P. is very intense. The Court sentences participants to a term of seven years in prison. That sentence is suspended and the participant completes four years of probation.
F.A.I.P. has several requirements. The participant must spend ten days in the Tarrant County Jail at the beginning of the program. Participants must allow a caseworker into their home. Participants must submit to urine testing, and attend weekly court hearings in Fort Worth. The Court uses both punishments and incentives on the participants. It is important that defense attorneys make sure their clients understand the risks associated with the Felony Alcohol Intervention Program. Even though many participants successfully complete the F.A.I.P. program, it is possible that participants will serve seven years incarcerated.
It is also important that criminal defense attorneys explain the benefits to their clients. This is especially true if the district attorney could seek a habitual offender enhancement. A habitual offender enhancement changes the punishment range of a felony case to 25-99 years or a life sentence. F.A.I.P. also helps people change their habits and their lives.
